También declaran ilegales los “espaciales” que vulneren “el terreno de juego, incluyendo las zonas del recinto deportivo visibles desde el mismo, a los que queda limitada la explotación conjunta de los derechos de contenidos audiovisuales“.
La Sala explica en la sentencia que “el artículo 7.1 del RD-Ley 5/2015, no le atribuye la aprobación de ningún Reglamento al ‘Órgano de Control’, cuya competencia se limita a la ‘gestión’ de los derechos audiovisuales de LaLiga“.
Además, añade que “tampoco en el artículo 10 del Reglamento de LaLiga le atribuye a este órgano competencias que vayan más allá del control, verificación, comercialización, reparto o explotación, conforme a las ‘normas estatutarias y reglamentarias‘”.
